    Default Partner visa process

    Hi guys,

    I'm new to this forum.
    I'm an Australia citizen residing in the UK and have been married to my British wife for 2.5 years although have lived together for about 8 years.

    In a few months we would like to apply for her permanent residency and as the Australian consular or dfat advice isn't particularly easy to follow I wonder if any of you who have gone through a similar experience would be kind enough to answer my questions?

    i) Do we need to fill out form 47SP even though by the time of submission we'd have been married for 3 years at least and would probably qualify for Permanent residency automatically? In which case, do we simply indicate we're applying for the permanent residency visa subcategory 100?

    ii) Regardless of the partner visa application, do I also need to fill out the sponsorship application form 40SP? Is this optional given the length of time we've been together or is not? If she's eligible for permanent residency straight away do I still need to fill out the sponsorship application form?

    iii) Does the price for the partner visa include her application form and my sponsor application for (if applicable)?

    I think that's all the questions I have at the moment, I appreciate you in advance for your help and efforts.

    Mark, fill out everything because granting the 100 is at their discretion, as I understand it.

    The fee covers everything. You don't pay for the myriad of forms (don't forget all the others you need - 888, 26, 80, etc etc. Download the booklet and make sure you have them all. The fee covers applying for both the 309 and 100 sub-class, should they grant a 309.

    Hi Mark,

    Your wife must use Form 47 SP (and form 80) for her visa application.
    You must use Form 40 SP for the sponsorship application.
    There is only one fee payable to DIAC.

    The application is both for sc. 309 and sc. 100.

    DIAC has the discretion to grant the permanent visa straight away because you are in a long standing relationship.

    Be very thorough when you prepare the application as a refusal is both very costly and frustrating. Make sure that your wife meets all the requirements for the visa and that you can meet all the sponsorship obligations.
