My son is almost two years old. I am an American, he is Australian. Born in Australia, I was there, I am on the birth certificate, I pay child support through the gov’t. Is there any hope for me to obtain citizenship or a Permanent Residency so that I can be with him full time?MarkKeymasterFebruary 26, 2014 at 8:50 pmPost count: 32
Hi mate, would I be right in thinking his mother is an Australian citizen? Permanent resident?
I gather by the child support comment you guys aren’t together any longer?
All the best

You are correct. I am living in Hong Kong, I am a US citizen, unfortunately the mother and I are not together.MarkKeymasterMarch 1, 2014 at 9:40 amPost count: 32
For something as important as this, I would be inclined to seek the advice of a good immigration lawyer mate however based on my own understanding, if your ex has legal custody of your child, the fact your child lives in Australia does not necessarily give you an automatic right to seek permanent residency or citizenship.

Thanks for the reply mate. I agree with you. Probably going to have to retain council. Thanks again.
